In the highly competitive video game industry, companies have always fought for market dominance. One way companies keep their positions is by obtaining exclusivity agreements with game publishers. Sony has come in for particular criticism for allegedly using its market dominance to suppress competition rather than offer players and developers more options.
US Senator Kevin Cramer recently wrote an open letter to Sony (spotted by Axios) CEO Kenichiro Yoshida, expressing concerns over company’s anti-competitive behavior regarding game exclusivity deals. The letter cites Sony’s attempt to oppose Microsoft’s proposed acquisition of Activision Blizzard and lobbying to FTC and other regulators as evidence of anti-competitive practices. Last month, four Republican members of Congress and six Democrats wrote similar letters accusing Sony of deliberately making exclusivity deals to ensure Xbox doesn’t gain a foothold in Japan.
Sony has defended its game exclusivity deals are necessary for the survival of the company. The company has invested heavily in creating its first-party studios to develop exclusive titles. Sony said, “We believe PlayStation community benefits greatly from get access to exclusive games on our platform, and we will continue to pursue and invest in partnerships to make this possible.”
Exclusivity deals are not unique to Sony, and other gaming companies like Microsoft and Nintendo have also used them. These deals are a necessary strategy for survival in the gaming industry, as gaming companies invest millions of dollars in developing games, and exclusivity deals help them recoup their investments. Furthermore, because they give gaming companies the incentive to invest in creating games, exclusivity agreements help the gaming industry’s competition grow.

Others claim that these agreements are essential for survival of video game industry. While some accuse Sony of engaging in anti-competitive behavior. Exclusive titles tend to be of higher quality than non-exclusive titles since they receive more funding and resources, benefitting players as they get to play games of higher quality. Furthermore, exclusivity agreements help the competitive environment of the gaming industry by enticing companies to spend money on game development.
In the gaming industry, exclusive game licensing agreements have long been a source of controversy. While some claim that Sony is acting unfairly to other companies, others contend that these agreements are essential to the gaming industry’s survival. Whether Sony’s actions are anti-competitive or essential to the industry’s survival will be determined by the regulators.
